CA Education Code 48900

Students may be suspended or recommended for expulsion for any of the acts enumerated in this regulation if the principal or the school in which the student is enrolled determines that the student has done any of the acts listed below. E.C. 48900:

a. Caused, attempted to cause, or threatened to cause physical injury to another person.

b. Possessed, sold, or otherwise furnished any firearm, knife, explosive or other dangerous object.

c. Unlawfully possessed, used, sold, or otherwise furnished, or been under the influence of any controlled substance, any alcoholic beverage, or an intoxicant of any kind.

d. Unlawfully offered, arranged, or negotiated to sell any controlled substance, an alcoholic beverage, or an intoxicant of any kind is unacceptable. This includes the representation of a liquid, substance, or material as a controlled substance alcoholic beverage, or intoxicant.

e. Committed or attempted to commit robbery or extortion.

f. Caused or attempted to cause damage to school property or private property.

g. Stolen or attempted to steal school or private property.

h. Possessed or used tobacco or any product containing tobacco or nicotine product, including, but not limited to cigarettes, cigars, miniature cigars, clove cigarettes, smokeless tobacco, snuff, chew packets, and betel, by students of the school while the students are on campus, or while attending school sponsored activities or while under the supervision and control of school district employees.

i. Committed an obscene act, or engaged in habitual profanity or vulgarity.

j. Unlawful possession of or unlawfully offered arranged, or negotiated to sell any drug paraphernalia.

k. Disrupted school activities or otherwise willfully defied the valid authority of supervisors, teachers, administrators, school officials, or other school personnel engaged in the performance of their duties.

l. Knowingly received stolen school property or private property.

m. Possessed an imitation firearm.

n. Committed or attempted to commit a sexual assault or a sexual battery

o. Harassed, threatened, or intimidated a pupil who is a complaining witness or witness in a school disciplinary proceeding

p. Caused, attempted to cause, threatened to cause, or participated in an act of hate violence or actions directed towards an individual or group that materially disrupt class work and creates a hostile environment

q. Made terrorist threats, either written or verbal, even if there is not intent to carry it out

48901.5 No person shall permit the possession or use of any electronic signaling device that operates through the transmission of radio waves, including, but not limited to, paging and signaling equipment.
